§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all contracts between Leif Sundelius, Boudoir-Fotografie, Hofkirchen 207, 84082 Laberweinting (hereinafter referred to as the ‘Photographer’), and his clients (hereinafter referred to as the ‘Client’) concerning photographic services. This applies in particular to boudoir, nude and portrait photo shoots, gift vouchers, events, and the delivery of photographs and photographic products.
(2) For the sake of readability, the term ‘customer’ is used to refer to all genders.
(3) Any terms and conditions put forward by the client shall only apply if the photographer expressly agrees to them in writing. Individual agreements, for example those made during a preliminary discussion or by email, shall take precedence over these Terms and Conditions.
(4) These Terms and Conditions shall apply to collaborations and TFP (Time for Prints) shoots only insofar as nothing else has been agreed in writing in individual cases.
§ 2 Conclusion of the Contract
(1) The information regarding packages and prices on the website does not constitute a binding offer, but rather an invitation to submit an enquiry or book an appointment.
(2) Booking an appointment via the online calendar: By clicking the ‘Book an appointment’ button, the customer books an available slot free of charge and without obligation. She will receive an automatic confirmation of receipt by email. This confirmation does not constitute acceptance of a contract. The photographer will keep the booked appointment available for [14 days]. If no contract is concluded within this period, the appointment will be made available again.
(3) Enquiries made via the contact form, by email or by telephone – including those regarding vouchers and event places – are also non-binding.
(4) A free preliminary consultation takes place before every shoot, either in person, by telephone or via video call. The contract is only concluded once the photographer has confirmed the booking in writing following the preliminary consultation (booking confirmation, usually by email). The confirmation specifies the package, the date, the price and the deposit.
(5) The photographer shall retain a copy of the contract. The client shall receive the booking confirmation, containing all essential details, and these Terms and Conditions in writing. The language of the contract is German.
§ 3 Legal age
Photo shoots are carried out exclusively with adults. By making a booking, the client confirms that she is at least 18 years old. The photographer is entitled to ask to see official photo ID prior to the shoot. If proof of having reached the age of majority cannot be provided, the shoot will not take place. Section 6(2) and (3) shall then apply mutatis mutandis as in the case of a last-minute cancellation.
§ 4 Prices and Payment
(1) The prices applicable are those in force at the time of booking confirmation. All prices are final prices and include statutory VAT.
(2) A deposit of 50 per cent of the package price is due upon receipt of the booking confirmation. This must be paid within 7 days, but no later than 3 days before the actual shoot date. The booking is only firmly confirmed once the deposit has been received. The deposit will be credited in full towards the package price.
(3) The balance is due no later than before the finished images are delivered. Payment methods: bank transfer, cash, PayPal.
(4) Additional services, such as extra photographs, albums, prints, additional outfits or extended sessions, will be charged separately in accordance with the current price list. Additional photographs cost €35 per photograph.
(5) If make-up and hair styling (MUA) are included in the package or booked as an additional service, the photographer will organise this. The service is usually provided by a self-employed make-up artist.
(6) Travel costs for photo shoots outside the studio will be charged as agreed: €0.75 per km from Laberweinting.
§ 5 Rescheduling by the client
(1) The customer may reschedule her appointment once free of charge, provided she gives notice no later than 5 days before the appointment. Any further rescheduling will incur a charge of 50 per cent of the package price. The deposit will be carried over in full to the new appointment.
(2) In the event of illness or any other valid reason, such as a death in the family, the appointment may be rescheduled at short notice free of charge. The client must then inform the photographer as soon as possible.
(3) The new date must be within 6 months of the original date.
§ 6 Withdrawal (Cancellation) by the Customer
(1) The customer may withdraw from the contract at any time. The notice of withdrawal must be in writing, for example by email. This does not affect the statutory right of withdrawal under Section 13.
(2) In the event of cancellation, the photographer may claim a lump-sum compensation. This shall amount to:
- up to 14 days before the appointment: [free of charge; the deposit will be refunded]
- 13–5 days before the date: 30 per cent of the package price
- [5 days to 48 hours] before the appointment: 50 per cent of the package price
- [less than 48 hours] before the appointment or no-show: 100 per cent of the package price
(3) The client is expressly entitled to prove that the photographer has suffered no loss or a significantly lower loss. The photographer is entitled to prove that the loss was greater. Any deposit already paid will be set off against the amount due.
(4) If the client cancels a photo shoot that has already begun, she may do so at any time and without giving a reason. In this case, the agreed price remains payable. Any costs saved will be taken into account: the client will receive the photographs taken up to that point, up to the limit of her package, where possible.
§ 7 Postponement and cancellation by the photographer
(1) If the photographer is unable to attend an appointment due to illness, force majeure or any other valid reason for which he is not responsible, he shall inform the client without delay. He shall then offer an alternative date.
(2) If the customer does not accept an alternative date, she shall be refunded in full all payments already made. Any further claims shall be subject to section 12 (Liability).
§ 8 The course of the photo shoot and the client’s participation
(1) The client must arrive on time for the agreed appointment. In the event of a delay, the duration of the photo shoot will be reduced accordingly, unless the photographer is able to extend it without difficulty.
(2) The client is responsible for providing her own outfits and accessories, unless otherwise agreed. Guidance on this is provided in the handbook, which the client will receive prior to the shoot.
(3) The client shall inform the photographer in advance of any health restrictions, allergies (including those to animal hair or make-up) or other circumstances that are relevant to the shoot. There are two dogs living in the studio. Upon request, they will remain in a separate area during the shoot.
(4) The client decides during the preliminary discussion what clothing to wear and how much skin to reveal. She may also change this at any time during the shoot. No photograph will be taken without her consent. Any physical contact, for example to adjust her hair or clothing, will only take place after asking for her permission first.
(5) The client may bring along a trusted companion. Upon request, the photographer’s wife will be present throughout the shoot.
(6) The photographer may terminate a photo shoot if the client or a person accompanying her behaves in a disrespectful or intrusive manner, or if she is clearly under the influence of alcohol or drugs. Section 6(4) shall then apply mutatis mutandis.
§ 9 Artistic design
(1) The photographer composes the images in accordance with his artistic vision and using his own visual style. This applies to lighting, poses, framing and post-production (‘Signature Look’). The client’s requests will be taken into account as far as possible.
(2) Complaints relating solely to the artistic design or visual style do not constitute a defect if the style is consistent with the work shown in the portfolio.
§ 10 Image selection, editing and delivery
(1) [Usually around two weeks] after the shoot, the client will receive a shortlist of her photos in a private, password-protected online gallery. She can then select her favourites from there. The number of photos included depends on the package booked.
(2) The selected images are carefully edited and are usually made available for download as high-resolution JPG files in the online gallery approximately two weeks after selection. Ordered albums and prints are then produced. Delivery times are non-binding estimates, unless they have been expressly agreed as binding.
(3) Retouching includes colour and lighting adjustments, as well as natural skin retouching. The removal of temporary blemishes and minor details is included. Body shapes will not be altered unless this has been expressly agreed. More complex special requests will be charged on a time-and-material basis.
(4) Unedited images (RAW files) and unselected images will not be released.
(5) The online gallery is accessible for 365 days from the date it is made available. The client is responsible for downloading her images during this period and backing them up herself. The gallery will then be deleted. The photographer will retain the final images for a further 12 months as a backup, but is under no obligation to do so. Unselected photographs will be deleted 3 months after the selection process has been completed.
(6) The login details for the gallery are confidential. The customer shall only disclose them to persons to whom she expressly wishes to grant access.
§ 11 Rights of Use, Copyright and Publication
(1) The photographer is the author of the photographs. The copyright remains with him.
(2) Upon full payment, the customer shall be granted a non-exclusive right of use, unlimited in time and geographical scope, to the images supplied for private purposes. Private purposes include, for example, personal prints, gifts to close friends and family, and use on private social media profiles. Commercial use, such as for advertising, sales, competitions or platforms with paid content, requires a separate written agreement.
(3) The client may crop the images for private use. Further editing, such as applying filters, retouching or creating montages, is not permitted. If the client publishes images on the internet, the photographer would appreciate being credited (‘Photo: Leif Sundelius’). However, this is not compulsory.
(4) Confidentiality: The photographer shall not publish any images of the client, whether on his website, on social media, in portfolios, in competitions or elsewhere, without her separate, express and written consent. Consent is voluntary and shall not affect the price or the service provided. The client may withdraw this consent at any time with future effect. Materials that have already been printed are not affected by the withdrawal.
(5) Clients’ names and personal details shall be treated as confidential and shall not be disclosed to third parties, unless this is necessary for the performance of the contract, for example to the make-up artist or a photo lab.
§ 12 Liability
(1) The photographer shall be liable without limitation for wilful misconduct and gross negligence. He shall also be liable without limitation in the event of death, personal injury or damage to health, as well as under the Product Liability Act.
(2) In cases of slight negligence, the photographer shall only be liable if he breaches a fundamental contractual obligation. A fundamental contractual obligation is an obligation the fulfilment of which is essential to the proper performance of the contract and on the observance of which the client may reasonably rely. In this case, liability is limited to the foreseeable damage typical for this type of contract. It shall not exceed the agreed price.
(3) The photographer works with professional equipment, spare equipment and a dual data backup system. Should images nevertheless be lost through no fault of the photographer’s – for example, due to a technical fault – the photographer shall offer a replacement photo shoot free of charge. Any further claims shall be subject to paragraphs 1 and 2.
(4) The photographer shall only be liable for clothing, jewellery and other items brought by the client in accordance with paragraphs 1 and 2. The same applies to allergic reactions to make-up brought by the client.
§ 13 Right of withdrawal for consumers
Consumers are entitled to a statutory right of withdrawal in respect of contracts concluded exclusively by means of distance communication (for example, by email or telephone). Further details are set out in the following withdrawal policy.
Cancellation Policy
Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date the contract is concluded.
To exercise your right of withdrawal, you must inform me (Leif Sundelius, Hofkirchen 207, 84082 Laberweinting, telephone: +49 176 6204 6612, email: hello@leifsundelius.com) by means of a clear statement (e.g. a letter sent by post or an email) informing me of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, although this is not compulsory.
To comply with the withdrawal period, it is sufficient for you to send notification of your intention to exercise your right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, I shall refund to you all payments I have received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the cheapest standard delivery option offered by me), without delay and at the latest within fourteen days of the day on which I receive notification of your withdrawal from this contract. I will make this refund using the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this refund.
If you have requested that the services commence during the withdrawal period, you must pay me a reasonable sum corresponding to the proportion of the services already provided up to the time you notify me of your exercise of the right of withdrawal in respect of this contract, compared with the total scope of the services provided for in the contract.
End of the cancellation policy
Note regarding early expiry: If the photo shoot is to take place within the withdrawal period, the photographer shall, at the time of booking, request the client’s express consent for him to commence the service before the expiry of the withdrawal period. The right of withdrawal expires once the photographer has fully performed the service and the client has expressly agreed to this in advance and confirmed that she forfeits her right of withdrawal upon full performance of the contract.

§ 14 Vouchers
(1) Vouchers may be purchased for a specific package (service voucher) or for a specific monetary amount (value voucher). The purchase price must be paid in full before the voucher is issued.
(2) Vouchers are valid for three years from the end of the year in which they were purchased. The expiry date is shown on the voucher.
(3) Vouchers are transferable. They cannot be redeemed for cash. Any remaining balance on a voucher remains valid until the expiry date.
(4) The photography session will be arranged subject to availability. These Terms and Conditions, in particular Sections 5 and 6, apply to the session booked using the voucher. In the event of cancellation, the voucher does not lapse; it remains valid until its expiry date. Any compensation payable under Section 6(2) shall be deducted from the value of the voucher.
(5) Recipients must meet the conditions set out in section 3 (being of legal age).
§ 15 Events
(1) For events, such as themed or mini photo shoots on fixed dates, the details provided on the relevant event page apply: date, time, venue, services, price and number of participants.
(2) By clicking ‘Reserve a place’, the customer is making a non-binding enquiry. The place is considered to be booked in earnest as soon as the photographer has confirmed it in writing and the customer has paid the full amount within 7 days. Places are allocated in the order in which payment is received.
(3) If the customer is unable to attend, she may nominate a substitute who meets the requirements set out in Section 3. Otherwise, Section 6 shall apply mutatis mutandis. It is possible to reschedule to another event date, subject to availability.
(4) The photographer may cancel an event if the specified minimum number of participants has not been reached by 7 days prior to the event, or for a valid reason as set out in Section 7. Any payments already made will then be refunded in full or, upon request, credited towards another date.
§ 16 Data Protection
The photographer processes the customer’s personal data, including photographs, solely for the purpose of fulfilling the contract and in accordance with the relevant legal provisions. Further details can be found in the privacy policy.
Section 17: Resolution of consumer disputes
The photographer is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
§ 18 Final Provisions
(1) The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
(2) If the client is a businesswoman, a legal person governed by public law or a special fund governed by public law, the place of jurisdiction shall be the photographer’s registered office.
(3) Should any provision of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the relevant statutory provision.
(4) Translations of these Terms and Conditions are provided for information purposes only. The German version shall prevail.
